Terms of Use

These Terms of Use ("Terms") are an agreement between you and Koda Digital LLC ("Koda Digital", "we", "our", or "us"). They apply when you use the Koda Baby mobile app and the kodababy.com website (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. Not Medical Advice

Koda Baby provides general feeding information for educational purposes only. It is not medical advice and does not replace the advice of your pediatrician or another qualified healthcare provider. Always talk to your pediatrician before starting solids, introducing allergens, or making changes to your baby's diet, and especially if your baby has allergies, a medical condition, or feeding difficulties. If you think your baby is having an allergic reaction or a medical emergency, call your local emergency number immediately.

Meal plans, portions, shopping lists and Feeding Q&A answers are generated automatically by software, based on the information you enter and on AAP or WHO guidance. They can contain mistakes or omissions. You are responsible for checking every food and ingredient for your baby's age, allergies, and choking risk before serving it, and for preparing food safely.

2. Who Can Use Koda Baby

You must be at least 18 years old (or the age of majority where you live) to create an account. Koda Baby is intended for parents and caregivers. It is not intended for use by children.

3. Your Account

You're responsible for the information you provide, for keeping your password secure, and for activity under your account. Please let us know at [email protected] if you believe your account has been accessed without your permission.

4. Free Plan and Premium

Free plan: Each account can generate a limited number of meal plans for free (currently 3). This limit counts every plan generated, including plans you later delete.
Premium: Premium is a one-time purchase, not a subscription. It currently unlocks unlimited meal plans and Feeding Q&A. The price is shown in the app before you buy.
Payment and refunds: Purchases are processed by Apple (App Store) or Google (Google Play) and are subject to their terms. We don't receive your payment details. Refund requests are handled by Apple or Google under their refund policies.
Restoring purchases: You can restore Premium on the same account using "Restore Purchase" in the app.
Deleting your account: If you delete your account, your Premium access is removed from that account along with your data.
Changes to features: We may add, change, or remove features over time. We won't remove the core features included in Premium for people who have already purchased it, unless we discontinue the Service as a whole.

5. Acceptable Use

When using the Service, you agree not to:

Use it for any unlawful purpose or in violation of these Terms
Try to get around the free plan limit, purchase checks, or other restrictions
Interfere with, overload, or try to gain unauthorized access to the Service or its systems
Copy, resell, or redistribute the Service, or use automated means to extract content from it
Reverse engineer the app, except where the law allows it

6. Your Content

You keep ownership of the information you enter, such as your baby's age, allergies and questions. You give us permission to use it to operate and improve the Service, as described in our Privacy Policy. The meal plans generated for you are yours to use, print, and share for personal, non-commercial purposes, for example with family, caregivers, or your pediatrician.

7. Our Content and License

The Koda Baby app, website, name, logo, and content are owned by Koda Digital LLC. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your own non-commercial use, in line with these Terms and the rules of the app store you downloaded it from.

8. Ending Your Use

You can stop using the Service at any time, and you can delete your account and data from the Profile tab in the app. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we need to for legal reasons. If we discontinue the Service entirely, we will give reasonable notice where we can.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including that the Service will be accurate, complete, uninterrupted, or error-free, or that it is fit for a particular purpose. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.

10. Limitation of Liability

To the fullest extent the law allows, Koda Digital LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on information provided by the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or US $50. Some places don't allow these limits, so they may not apply to you.

11. App Store Terms

If you downloaded Koda Baby from the Apple App Store, you and we acknowledge that:

These Terms are between you and Koda Digital LLC only, not Apple. Koda Digital LLC, not Apple, is solely responsible for the app and its content.
Your license to use the app is limited to use on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
Koda Digital LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
Koda Digital LLC, not Apple, is responsible for investigating and resolving any claim that the app infringes a third party's intellectual property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you downloaded the app from Google Play, the Google Play Terms of Service also apply to your use of Google Play.

12. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will update the date at the top of this page and let you know in the app or by email. If you keep using the Service after the changes take effect, you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia and applicable U.S. federal law, without regard to conflict-of-law rules. This does not take away any protections you have under the mandatory consumer laws of the place where you live.
